Widerrufsbelehrung

Der Kunde kann innerhalb von zwei Wochen nach erhalt dieser Belehrung in Textform, aber frühestens mit dem Erhalt der Ware, in Textform (z.B. Brief, Fax, E-Mail) oder durch Rücksendung der Wahre und ohne Angabe von Gründen vom Kaufvertrag zurücktreten. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Wahre.

Im Falle des Rücktritts vom Kaufvertrag sind beiderseitig empfangene Leistungen zurück zu gewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Kann der Kunde die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurück gewähren, muss er Oye Records insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung – wie sie dem Kunden etwa im Ladengeschäft möglich gewesen wäre – zurückzuführen ist. Im Übrigen kann der Kunde die Wertersatzpficht für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung vermeiden, indem er die Sache nicht wie sein Eigentum in Gebrauch nimmt und alles unterlässt, was deren Wert beeinträchtigt. Für Wertverlust der vom Kunden zurück erstatteten Ware, welcher durch eine Behandlung der Ware entsteht, die über die übliche Prüfung dieser wie sie im Ladengeschäft möglich ist hinausgeht, ist vom Kunden Wertersatz zu leisten.

Paket versandfähige Sachen sind auf unsere Gefahr zurückzusenden. Der Kunde hat die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn der Kunde bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für den Kunden kostenfrei. Nicht Paket versandfähige Sachen werden beim Kunden abgeholt. Verpfichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für den Kunden mit der Absendung der Widerrufserklärung oder der Sache, für Oye Records mit deren Empfang.

Cancellation policy

You may cancel your contractual statement in written form (e.g. letter, email) or, if the object is given to you before the end of the period, by return shipment of the object. The appropriate period begins on receipt of this notice in written form, but not before the receipt of the goods at the consignee (in case of recurring shipments of similar goods not before the receipt of the first partial shipments). Likewise, the period also does not start before the fulfilment of our duty to inform according to article 246, paragraph 2 in connection with paragraph 1, subparagraph 1 and 2 EGBGB as well as our duties according to paragraph 312e, subparagraph 1, clause 1 BGB in connection with article 246, paragraph 3 EGBGB. In order to maintain the period it is sufficient to send the cancellation or return the goods in due time. The cancellation must be addressed to:

Legal consequences of return

In the case of an effective cancellation, the goods and services received by both parties must be re-conceded and, if applicable, derived benefits (e.g. interest) must be surrendered. In case you are unable to completely or partly surrender the received goods and services, or only in deteriorated condition, you may be obliged to perform appropriate compensation. This does not apply to the surrender of goods if the deterioration of the goods is the sole result of their examination, as it would have been possible for you in a retail shop. Apart from that, you can avoid compensation by not using the goods as your property and abstain from any action that could diminish them in their value. Goods that are suitable for parcel shipment are to be returned at our risk. You are obliged to bear the costs of returning the goods as long as the goods delivered correspond to the offer and if the price of the goods to be returned does not exceed a value of €40 (40 euros), or if, in case of a higher price of the goods, you have not yet returned services or fulfilled a contractual instalment. Otherwise the return consignment is free of charge. Goods that are not suitable for parcel shipment are picked up at your premises. You must fulfil any obligations to refund payments within thirty days. That period begins with your sending of the cancellation statement or of the object. For us, it begins with the receipt of the cancellation statement or the goods.

Special notes

Your right of cancellation expires prematurely in case the contract is completely fulfilled by both parties upon your express wish, before you have used your right of cancellation. "End of cancellation instructions"
